General Terms & Conditions

Effective Date: March 3, 2026

1. Services & Scope

Little Smiles provides professional maternity and newborn photography services delivered at Client's home in Zug and surrounding areas. The photographer (Daniel Vayman, trading as Little Smiles c/o Vayman ART) will provide creative direction, professional equipment, and post-processing of images. Session duration is determined during booking.

2. Session Fees & Payments

Maternity Session: CHF 250
Newborn Session: CHF 500

The session fee secures the exclusive date on the photographer's calendar and covers travel to Client's home, setup, creative time, and delivery of one (1) high-resolution digital image. Additional images and printed products (albums, prints) are purchased separately. Payment is due in full before the session via Bank Transfer, Twint, PayPal, or Cryptocurrency (BTC, ETH, SOL). A booking is only confirmed once payment is received.

3. Cancellation & Rescheduling Policy

Free Cancellation/Rescheduling:
• Medical emergencies or health-related reasons (with documentation)
• More than 31 days before scheduled session date

Partial Charge (50%):
• Cancellation 15-30 days before session date

Full Charge (100%, Non-Refundable):
• Cancellation less than 14 days before session date
• No-show without prior notice

Rescheduling requests follow the same terms as cancellations.

4. Image Rights & Licensing

The photographer retains copyright to all images created during the session. Upon payment of the session fee and any additional image purchases, Client receives a personal, non-exclusive license to use the images for private, non-commercial purposes. Client may print, share digitally with family and friends, and use for personal social media. Commercial use, resale, or public reproduction requires written permission. 5. Image Delivery & Post-Processing

The photographer provides professional post-processing of all delivered images including color correction, exposure adjustment, and light retouching. Delivery timeframe is typically 4-6 weeks after session. Images are delivered as high-resolution digital files (suitable for printing). RAW files are not typically provided unless requested and an additional fee applies.

6. Data & Privacy Policy

Client personal data (name, email, phone, address) is collected for booking and delivery purposes and is treated according to Swiss Data Protection Act (DSG) and GDPR. See Privacy Policy & Data Handling for complete information.

7. Minors & Parental Consent

Sessions involving children (minors under 18) require parental/guardian consent. By booking a session, parent/guardian confirms they have authority to consent to photography and image usage as described. The photographer may request signed consent forms for children not accompanied by parents.

8. Safety & Liability

The photographer is certified in Newborn Safety Training (UK 2024) and follows strict safety protocols during all sessions. Client assumes responsibility for their infant's comfort and wellbeing. The photographer is not liable for infant distress, crying, or refusal to cooperate during sessions. Sessions are scheduled for up to 4 hours; if the baby does not settle after 2.5 hours, free rescheduling is available.

9. Limitation of Liability

The photographer provides services on an "as-is" basis. In the event of technical failure (equipment malfunction, lost files, etc.), the photographer's liability is limited to a refund of the session fee only. The photographer is not liable for any consequential damages, emotional distress, or indirect losses.

10. Cancellation by Photographer

The photographer reserves the right to cancel or reschedule a session due to: illness, emergency, severe weather conditions, or safety concerns. In such cases, Client is offered a full refund or priority rescheduling at no additional cost.

11. Use of Images for Portfolio & Marketing

The photographer reserves the right to use images from sessions for: professional portfolio, website display, social media marketing, and professional publications. Client may opt-out of portfolio/marketing use by requesting in writing at the time of booking. This does not affect Client's personal license to use images.

12. Dispute Resolution & Governing Law

These terms are governed by Swiss law. Any disputes arising shall be resolved through good-faith negotiation. If unresolved, disputes are subject to the jurisdiction of the Commercial Court of the City of Zug, Switzerland.

13. Amendments

Little Smiles may update these terms at any time. Continued use of services or rebooking constitutes acceptance of updated terms. Clients will be notified of material changes via email.
